      Virgin Money London Marathon 2020: Terms and Conditions

      By registering for a secured place in the Virgin Money London Marathon 2020, you are agreeing to the below terms and conditions.

      1. You understand that it is your responsibility to read any terms and conditions issued by the race organisers and to comply with these terms and conditions.
      2. You consent to be contacted by us by email, phone, SMS and post in relation to the specific event you have registered for to ensure that Action on Hearing Loss can deliver the necessary administration and communication required to complete your successful participation in the event.
      3. You acknowledge that the registration fee you will need to pay to secure your place is non-refundable and cannot be used towards your Sponsorship Pledge.
      4. You acknowledge that this is a fundraising event and agree to raise a minimum amount of £2,000 (Sponsorship Pledge), excluding any Gift Aid and registration fee.
      5. If you drop out of the event five working days before the Virgin Money London Marathon charity console closes (the date of which is determined by the Virgin Money London Marathon – we will let you know when this date is once it has been decided) for any reason other than ill health, we will not be able to substitute or place somebody else in your space on our team and you will still be liable to pay the full Sponsorship Pledge amount.
      6. If you are unable to raise the full Sponsorship Pledge before the deadline on 25 September 2020, you will be required to pay the outstanding balance yourself.
      7. You understand that if you fail to raise the full Sponsorship Pledge before the deadline of 25 September 2020, you may also be placed on a low performers list held by the Virgin Money London Marathon organisers.
      8. For any independent fundraising events that you carry out to raise funds (for example a cake sale or pub quiz), you acknowledge that you are carrying such events out in your own capacity. It's your responsibility to organise all aspects of such event and make it clear that such event is run by you and is not run by Action on Hearing Loss. You also agree to make it clear that such event is not "on behalf of Action on Hearing Loss" and that Action on Hearing Loss will not accept any responsibility or liability for such event. If you wish to use the Action on Hearing Loss logo, please contact the Events team.
      9. You agree to secure a licence from the relevant local authority before collecting funds on the street or in a public place. You acknowledge you are responsible for obtaining any such licence and this is not the responsibility of Action on Hearing Loss.
      10. You agree to send all sponsorship funds collected or raised to Action on Hearing Loss no later than 25 September 2020.
      11. You agree to ensure any cheques relating to your sponsorship are made payable to Action on Hearing Loss and sent to the Action on Hearing Loss Events team with the event name and your full name.
      12. When fundraising, you will make your donors aware that a proportion of the money you raise will go towards the administrative cost of participating in the event. (Action on Hearing Loss has carefully calculated the Sponsorship Pledge to ensure that as long as you meet or exceed your pledge, the cost of your participation in the event will be covered and approximately 87% of the Sponsorship Pledge will go to Action on Hearing Loss. However it is critical you make your donors aware of this. The costs vary for each event; please contact the Action on Hearing Loss Events team for further information.)
      13. You will take responsibility for registering your contact details with the third party event organiser if required. Failure to do so will mean you cannot take part in the event. If this is necessary, we will inform you well in advance of what action is required.
      14. If you have to withdraw prior to the event, due to injury, you must notify Action on Hearing Loss immediately. Any money raised will be retained as a donation towards Action on Hearing Loss. If you wish to refund your donors in this instance, you must ask your individual donors to make a written request to Action on Hearing Loss, as they will be refunded directly.
      15. You consent to Action on Hearing Loss sharing your name, email address and contact details with the Virgin Money London Marathon (VMLM), the organiser of the event in which you are taking part. We will never share your data with any other third parties or use it in any other way, unless you have provided us with your consent. We will process your data in accordance with our Privacy Policy. We will retain your data for 10 years.
      16. The event which you are registering for is physically challenging and may pose a risk of discomfort, illness, injury, and even death. You need to be satisfied that you are physically capable of doing the event without undue risk to your health or life. We do not conduct health or fitness checks on entrants and the responsibility for your ability to participate in the event is with you as the participant.
      17. If you have a medical condition or are unsure of your physical ability to take part in the event, you must seek medical advice from a general practitioner prior to participating in the event.
      18. You acknowledge that Action on Hearing Loss is unable to provide insurance for fundraising activity, and that you are responsible for securing appropriate insurance cover if required for your fundraising activity.
      19. You acknowledge that you are fully responsible for your participation in the event and Action on Hearing Loss does not accept responsibility or liability for any loss or damage arising from the event.
      20. You consent to various photographs and/or film footage being taken of you as part of your participation in the event. You consent to photographs, film footage and sound recordings of you being taken and grant permission, free of charge, to us, our licensees and those authorised by us to use such photographs, film footage and recordings (including any copies) and for your image, likeness and voice to be included in pictures and/or on film and/or on sound recordings to be used for promotional and marketing purposes (including publication on the internet and social media) for this specific event and any other future Action on Hearing Loss events. You can withdraw your consent at any time however we will be unable to recall and destroy some printed materials that have been distributed or put into the public domain, such as our members' magazine and events leaflets, even if you have withdrawn your consent. We will retain a copy of the photographs, film footage and sound recordings for a period of three years.
      21. You consent to us using your reasons for wanting to run for Action on Hearing Loss that you provided to us in your application form to be used for promotional and marketing purposes (including publication on the internet and social media) for this specific event and any other future Action on Hearing Loss events. You can withdraw your consent at any time however we will be unable to recall and destroy some printed materials that have been distributed or put into the public domain, such as our members' magazine and events leaflets, even if you have withdrawn your consent. We will retain you reasons for wanting to run for Action on Hearing Loss for a period of three years.
      22. You consent and agree to provide us with a photograph of yourself for identification purposes only. We will never share your photograph with any other third parties or use the image in any other way, unless you have provided us with your consent to do so. We will process and use your photograph in accordance with our Privacy Policy. We will retain the photograph for three years.
      23. You will ensure all correspondence regarding your event participation is directed to events@hearingloss.org.uk or 0203 227 6177.
